Derogation
The MRA provides for a party to apply to MEC to be excused from a particular obligation of the MRA without which the MRA party may be potentially or actually in breach of the Agreement. A derogation is a temporary measure authorised by MEC until the necessary provisions can be made for a party or parties to meet the particular obligations. Derogations are granted by exception and a general expectation of compliance to the MRA is anticipated.
The derogation process is set out in Guideline 13.
